I Commitment to Privacy Compliance

This privacy policy is a statement of commitment by Elfred Enterprises Limited, trading as Ray White Invest (RWI), and its subsidiaries to comply with the applicable privacy legislation.

2 Legislative requirements

RWI is committed to the protection of the privacy by complying with the privacy standards set out in the Privacy Act 1988 (Cth) and the National Privacy Principles contained in the Act. A copy of the National Privacy Principles may be obtained from the Office of the Federal Privacy Commissioner or the Commissioners website, www.privacy.gov.au.

3 Information handling practices

3.1 Collection

RWI will only collect personal information where that information is required in connection with the provision of its products and services or to meet any legal obligation imposed on RWI.

RWI will:

  • use only fair and lawful ways to collect personal information; and
  • take reasonable steps to make you aware of why RWI is collecting the information, who will have access to that information, how it will be used and any legal requirement which requires RWI to collect the information.

RWI's business activities include the provision of finance products and services. In the course of conducting these activities, RWI is required to collect personal and/or sensitive information including without limitation your name, postal or email address, date of birth, financial details, tax file number, health information or other information RWI considers necessary.

3.2 Use and Disclosure

RWI will only use or disclose information about you for the purpose of providing RWI's products and services or where otherwise legally required.

In certain cases RWI will collect your personal information from third parties. For example, we may need to collect personal information from a credit reporting agency, your representative (such as a legal adviser), your financial adviser, your employer or publicly available sources of information or any other organisation where you have given your consent.

It may be necessary to share information to meet your specific needs, such as where you have a financial adviser, or with providers of services to RWI, such as internet, information technology and mail out services. In all circumstances, RWI ensures that such service providers are bound by strict confidentiality requirements to ensure the privacy of your information.

Some examples of related third parties to whom personal information may be disclosed include:

  • organisations involved in providing, managing or administering your product or service such as lenders, mortgage insurers and our advisers;
  • your financial advisers and their service providers;
  • your representatives including your legal advisers, executor, administrator, trustee, guardian or attorney;
  • financial institutions and organisation at their request if you seek finance from them; and
  • third parties as required or authorised by law, for example, to government or regulatory bodies for purposes related to public health or safety, the prevention or detection of unlawful activities or to protect public revenue.

RWI may also use personal information collected from you to help analyse the quality of its services and to design better financial products for its clients. In all circumstances, personal information is de-identified so that your details cannot be identified.

3.3 Storage and old records

RWI will take reasonable steps to ensure that the personal information collected and used is accurate, complete and up to date. RWI will take reasonable steps to destroy or permanently de-identify personal information if it no longer needs it for any purpose.

3.4 Security

RWI will take reasonable steps to protect your personal information from misuse, loss and from unauthorised access, modification or disclosure. All personal information will be classified and secured according to its level of sensitivity.

3.5 Review of Policies

RWI reserves its right to review and amend this policy from time to time.

You have the right to request access to your own personal information. To request access to this information you should contact RWI using the contact details set out below.

You can ask for information about you to be corrected, if it is inaccurate, incomplete or out of date. Where requested, RWI will take reasonable steps to correct the information.
